TITLE: Approve the Second Amendment to the Subrecipient Agreement Between Sarasota County, Florida and the City of North Port, Florida for Greenwood Avenue Sidewalk Construction, Extending the Timeline to September 30, 2025, and Authorize the City Manager or the Mayor, as Applicable Under the City Charter, to Execute all Funding Documents After Legal Review.
Recommended Action
Approve the Second Amendment to the Subrecipient Agreement Between Sarasota County, Florida and the City of North Port, Florida for Greenwood Avenue Sidewalk Construction, extending the timeline to September 30, 2025, and authorize the City Manager or the Mayor, as applicable under the City Charter, to execute all funding documents after legal review.
Background Information
The City of North Port has a Subrecipient Agreement with Sarasota County for the receipt and use of Community Development Block Grant (CDBG) funds for the Greenwood Avenue Sidewalk Construction. The Grant will reimburse the City up to $305,000 for construction costs.
Based on several factors, including Hurricane Ian and its impact on areas near and about the construction area, the City requested and was a granted an initial timeline extension until May 1, 2024. The initial timeline extension date is reflected in the partially executed First Amendment.
In the Fall of 2023, Sarasota County notified the City of North Port that there were contractual irregularities discovered by their legal team requiring new contracts to be issued for all CDBG projects. This is why the First Amendment granting the extension is only partially executed, as the irregularities were discovered after execution by the City but before execution by the County. The Second Amendment corrects the irregularities and also extends the timeline allowing for a project delay due to a non-responsive Surveyor. The timeline for completion of the project is now extended to September 30, 2025.
The Second Amendment to the Subrecipient Agreement Between Sarasota County, Florida and the City of North Port, Florida for Greenwood Avenue Sidewalk Construction has been reviewed by the City Attorney and is legally correct as to form.
