Background Information
 
On October 10, 2006, the City Commission adopted Ordinance No. 06-30 establishing a Construction Traffic Road Fee. City Code Section 66-69, previously Section 66-68, outlines the City’s Construction Traffic Road Fee and codifies the amount of the road fee assessed at the time of building permit issuance. These road fees have remained unchanged in this chapter of the City Code since they were first adopted. 
 
City Code Appendix A establishes the City’s Fee Schedule, which is updated regularly as part of the budget process and as needed. On September 12, 2023, the City Commission adopted Ordinance No. 2023-21 amending Appendix A - City Fee Structure, which included increases to the Construction Traffic Road Fee, resulting in a conflict between Appendix A and the fees codified in City Code Section 66-69.
 
Proposed Ordinance No. 2024-11 modifies Section 66-69 (a) (1) and (2) to remove reference to specific fees to allow the City Fee Schedule to act as the single source for fee lists and updates. 
 
In addition, the proposed ordinance includes changes to clarify the application of the Construction Traffic Road Fee with an amendment of Section 66-69 (b) to state: “The construction traffic road fee applies to new construction and additions but will not be charged for the renovation or interior remodeling of an existing structure.” 
 
Ordinance No. 2024-11 has been reviewed by the City Attorney and is legally correct as to form.
 
Information for Second Reading
 
The City Commission heard this item at the June 25, 2024, meeting and voted unanimously to continue Ordinance No. 2024-11 to second reading on July 23, 2024. 
 
In accordance with Florida Statutes Section 166.041(4)(a), the City timely posted a business impact estimate on the City’s website on or before the date the newspaper published notice of this ordinance’s final reading.
