Recommended Action

Option 1: Approve Resolution No. 2025-R-83 as presented.

City Commission Options

Option 1: Approve Resolution No. 2025-R-83 as presented.
* Pros: The vacation brings the subject property into compliance with the Unified Land Development Code (ULDC).
* Cons: The comprehensive staff analysis concluded that there are no identifiable drawbacks to the approval of Resolution No. 2025-R-83.

Option 2: Deny Resolution No. 2025-R-83.
* Pros: The easement will remain as platted, consistent with the area.
* Cons: The property will remain in violation of the ULDC and required easements. The burden of zoning non-compliance for the property owner persists.

Background Information

On July 10, 2025, the Planning & Zoning Division received an application petitioning the City of North Port to grant a vacation of two platted 6-foot side utility and drainage easements located on to Lots 12, 13 and 14, Block 235, 8th Addition to the Port Charlotte Subdivision. The purpose of this application is for flexibility of use for the property owner on the combined lots. The platted six-foot (6') side utility and drainage easement to be vacated encompass approximately 2,640 square feet.

The City Attorney's Office reviewed and approved the proposed Resolution No. 2025-R-83 as to form and correctness.

Resolution No. 2025-R-83 was provided to the City Clerk's Office on October 14, 2025, for signature, subject to City Commission approval.
