Recommended Action

First Reading - Motion to continue Ordinance No. 2025-20 to second reading on September 23, 2025, as presented. OR Motion to continue Ordinance No. 2025-20 to second reading on September 23, 2025, with the following changes (insert changes).

Second Reading - Motion to adopt Ordinance No. 2025-20 as presented.

Background Information

Currently, Article IX. - Code Enforcement, Sec. 2-510. - Subpoena procedures, (a) of the Code of the City of North Port, Florida, states:

Sec. 2-510. Subpoena procedures.

(a) Subpoena for testimony before the hearing officer. Every subpoena for testimony before the hearing officer shall be issued by the clerk to the city commission under the seal of the city. Each subpoena shall state the name of the hearing officer, the title of the action, the case number of the action, the name and address of the person to whom the subpoena is issued and the time, place and location of the hearing at which the person is directed to appear and shall be prepared by the party requesting issuance.

It is the recommendation of the City Clerk, City Attorney's Office, and Code Enforcement Division of the Development Services Department that Article IX. - Code Enforcement, Sec. 2-510. - Subpoena procedures, (a) of the Code of the City of North Port, Florida, be amended to comply with Florida Statutes Section 162.08, authorizing the City's Hearing Officer to perform the above duties. As such, this proposed amendment has been included in Ordinance No. 2025-20 for the Commission's review and consideration.
