Recommended Action

Approve the Second Amendment to Contract No. 2023-07, Construction Manager at Risk for Construction Phase Services, Phase II, with Wharton Smith, Inc. for the Demolition and Construction of Fire Station 81, increasing the Agreement fees by $15,507,229.00 for a new total amount of $15,674,884.92.

Background Information

The following provides a chronological order of events regarding the remodeling, demolition, installation of a temporary fire station and construction of a new, storm-hardened Fire Station 81:

> April 25, 2023: During the City Commission Regular Meeting, the Commission approved Contract 2023-07 with Wharton Smith, Inc., for Construction Manager at Risk Contract Preconstruction Services Contract, Phase I in the amount of $42,340.09 for the Remodel of Fire Station 81. The initial plan for this project was to add square footage to meet the need of the growing administration as well as remodel and update an aging fire station.

> September 2022: Hurricane Ian made landfall and significant damages were sustained to Fire Station 81. The repairs needed as well as the previous expansion and remodel plans exceeded the National Flood Insurance Program 50% rule administered by the Federal Emergency Agency (FEMA), requiring the fire station to be upgraded to current building codes and proper hardening as a Florida Building Code Essential Facility.
