TITLE: A Resolution of the City Commission of the City of North Port, Florida, Terminating Portions of Utility and Drainage Grants of Easements in Sections 28, 29, 32, and 33, Township 39 South, Range 21 East Located in Sarasota County Florida; Providing for Incorporation of Recitals; Providing for Partial Termination and Release of Easements; Providing for Recording; Providing for Conflicts; Providing for Severability; and Providing an Effective Date.
Recommended Action
Approve Resolution No. 2025-R-12 as presented.
Background Information
The City of North Port, as a successor to General Development Utilities, Inc., previously operated and maintained an effluent tank, and appurtenances by non-exclusive ingress and egress easements on property currently owned by Sabal Trace Development Partners, LLC (Sabal Trace).
Sabal Trace Corporation granted the City of North Port a non-exclusive easement for the purpose of stormwater drainage recorded in the Official Records of Sarasota County as Instrument Number 1999081143.
Per the Developer Agreement between Sabal Trace and the City of North Port, new infrastructure to serve their development will be installed, and the existing infrastructure will be taken out of service and removed. Sabal Trace has requested the City terminate and release several portions of the existing easements and new easements will be granted and identified as part of the plat.
Resolution No. 2025-R-12 has been reviewed by the City Attorney and is legally correct as to form.
