Approve Resolution No. 2024-R-39 as presented.

Background Information

On March 13, 2024, the Planning & Zoning Division received an application petitioning the City of North Port requesting a vacation of the 20-foot Public Drainage easement and 20-foot Public Utility easement indicated on the North Port Gateway West plat as recorded in Plat Book 43, Page 33, Lots 1 and 2. The applicant is requesting to vacate the easements recorded through Instrument numbers 2007080765 and 2007080766, Public Records of Sarasota County in order to replat the subdivision and establish new easements. The subject property is zoned Planned Community Development (PCD) and has a future land use of Activity Center.

Pursuant to Florida Statutes Chapter 177, an application has been made to the City of North Port to formally request to vacate the platted 20-foot Drainage and Public Easement on the North Port Gateway West plat as recorded in Plat Book 43, Page 33, Lots 1 and 2.

A legal notice of intent to vacate the easements was published by the property owners in a newspaper of general circulation, for two (2) weeks consecutively.

The affected drainage and utility agencies have been notified of the vacation request and through written responses, have granted their approval.

Resolution No. 2024-R-39 has been reviewed by the Interim City Attorney and is legally correct as to form.
