Recommended Action

 

Approve Resolution No. 2024-R-32 as presented.

 

Background Information

 

On September 10, 2019, the City of North Port and West Villages, LLLP, (“Developer”) entered into an Amended and Restated Utilities Agreement requiring the Developer to construct and transfer certain water and wastewater systems to the city. The West Villages Improvement District (WVID) has constructed infrastructure improvements as outlined in the Agreement.

 

The infrastructure located within the Brightmore at Wellen Park Phases 1A-1C, 2A, & 3 is now complete, therefore, this Resolution is necessary to identify what infrastructure the City is accepting from the developer. The City holds easement rights to access, operate, and maintain the infrastructure and all related warranties have been assigned to the City.

 

Resolution No. 2024-R-32 has been reviewed by the City Attorney and is legally correct as to form.
