TITLE: Discussion and Possible Action Regarding City Code Section 2-511 Regarding the Settlement and Release of Fines and Liens and Foreclosure Actions on Unpaid Liens (Requested by Commissioner McDowell).
Recommended Action
Direct the City Manager to bring back suggested amendments to the Code of the City of North Port, Florida, Section 2-511(D) Settlement of Fines and Liens and Section 2-511(E) Action to Foreclose based on the discussion.
Background Information
Abandoned properties are prevalent throughout the City. Through the Code Enforcement process, the City incurs fines and fees for various reasons including mowing and boarding up the abandoned property. These fines and fees result in liens being placed on the property. Several instances have been brought to my attention where the fees and fines are much higher than the value of the property. The blight conditions of the abandon property often devalue the neighboring properties.
The Code of the City of North Port, Florida, Section 2-511(D)1 offers a lien release program for property owners. However, it cannot be applied to any lien imposed after October 25, 2010, and property must in compliance with all City codes. The Code of the City of North Port, Florida, Section 2-511(D)3 is for properties with a pending sale (a bona fide contract) and requires the property to be brought into compliance within 90 days of the closing. Failure to meet that deadline reinstates the original fine amount AND does not apply to any lien imposed after October 25, 2010.
