Background Information

The City of North Port, as a successor to General Development Utilities, Inc., was granted non-exclusive ingress and egress easements identified and recorded in the official records of Sarasota County as Books 1856 and 2450, Pages 1799, 1804, and 2324, respectively. Sabal Trace Development Partners, LLC (Sabal Trace) entered into a developer agreement with the City dated July 23, 2019, which identified existing utility facilities and associated easements located within the property and the requirements for new utility easements as the redevelopment process begins. Pursuant to Section 3 of the Developer's Agreement, Sabal Trace has removed the old, existing facilities described in the Developer's Agreement and installed water, wastewater, and reclaimed water facilities, concurrent with the City's approval of the plat of Central Parc Phase 1, which covers a portion of the property. New utility and other easements have been created and granted to the City in the plat to accommodate the new water and wastewater utility and other facilities, which was approved by Commission on January 9, 2024.

Resolution No. 2024-R-09 has been reviewed by the City Attorney and is legally correct as to form.
