Recommended Action

The City Commission approve Resolution No. 2024-R-06, Petition No. VAC-23-135, Panacea Commercial Park Phase 1 Subdivision.

Background Information
On June 2, 2023, Todd Mathes, formally submitted to the City of North Port a written petition to request the vacation of Progress Court and all internal easements that are associated with any lots/tracts on the entire plat. The 10-foot easement along Plantation Boulevard will remain at the request of Florida Power and Light Company.
The purpose of the vacation is to allow the applicant to reconfigure the area to fit the next phase of development for the area allowing the existing industrial uses to the south to expand. If the request is granted, approximately 182,192.58 square feet (4.183 acres) of the easement will be vacated (Figure 1).

The subject property is zoned Planned Community Development (PCD) with a Future Land Use Designation of Activity Center (AC-4).
Resolution 2024-R-06 has been reviewed by the City Attorney and is legally correct as to form.

Petition No. VAC-23-135 is scheduled for Public Hearing with the Planning and Zoning Advisory Board (PZAB) on January 4, 2024. The due date for the City Commission agenda is prior to this PZAB Meeting. Staff will update the City Commission on the PZAB recommendation ...
