Recommended Action

Approve the Memorandum of Understanding by and between the Sarasota County Sheriff's Office and the City of North Port, Florida on Behalf of the North Port Police Department for the Appointment of Deputy Sheriffs.

Background Information

The Sheriff of Sarasota County, Florida is empowered under Florida Statute ?30.07 to appoint deputy sheriffs to act under him, and who once appointed, have the same powers, duties, and obligations as the sheriff. The North Port Police Department (NPPD) has a need, from time to time, to have some of its law enforcement officers empowered as deputy sheriffs within Sarasota County, Florida.

Under this Memorandum of Understanding (MOU), the number of NPPD officers appointed as deputy sheriffs will be set by the Sarasota County Sheriff's Office (SCSO). The purpose of the MOU is to outline the duties and responsibilities of NPPD law enforcement officers who are appointed as deputy sheriffs by SCSO.

The Commission of the City of North Port approved the current MOU with SCSO on May 11, 2021. This MOU will supersede the current MOU and will remain in effect unless otherwise terminated by either party with written notice.

The Memorandum of Understanding has been reviewed by the City Attorney and is legally correct as to form.
