Approve Resolution No. 2023-R-85 as presented.

 

Background Information

 

The Subordination of City Utility Interests Agreement between State of Florida Department of Transportation (FDOT) and the City of North Port allows the City of North Port Utilities Department to construct, operate, maintain, improve, add to, upgrade, remove, and relocate facilities on, within the FDOT right of way along the South side of Tamiami Trail in Wellen Park as well as provides FDOT access to the easements for highway purposes and sidewalk maintenance. FDOT parcel 805.4 identifies several overlaps of the sidewalk easement and utility easement created in Wellen Park Downtown Phase I as described in plat book 54, page 331, recorded in the Sarasota County public records as instrument no. 2021065173.

 

Resolution No. 2023-R-85 has been reviewed by the City Attorney and is legally correct as to form.
