Recommended Action

 

Approve Resolution No. 2023-R-83 as presented.

 

Background Information

 

During a Regular City Commission Meeting on January 26, 2009, the City Commission moved to approve Resolution No. 09-R-05 granting a non-exclusive temporary utility easement over, under and across a portion of land lying within the City of North Port site commonly identified as the City Center Complex to T-Mobile South, LLC. for the purposes of providing utility service to the T-Mobile telecommunications site located on the North Port Road and Drainage site to the immediate east of the City Center Complex. 

 

DISH Wireless, LLC, previously known as T-Mobile South, LLC, desires to extend the existing utility easement agreement approved via Resolution No. 09-R-05 for the remainder of the route along City Center Boulevard, from Kramer Boulevard to Sumter Boulevard.

 

Resolution No. 2023-R-83 has been reviewed by the City Attorney and is legally correct as to form.
