TITLE: A Resolution of the City Commission of North Port, Florida, Approving and Authorizing the Mayor to Execute the State of Florida Department of Transportation Memorandum of Agreement for Reimbursement of Certain Costs Associated with City's Maintenance, Mowing, and Litter Removal along U.S. Highway 41 from Ortiz Boulevard to the County Line; Providing for Incorporation of Recitals; Providing for Conflicts; Providing for Severability; and Providing for an Effective Date.

Approve Resolution No. 2023-R-82.

Background Information

During the time period of 1995 through 2008, the City of North Port and the Florida Department of Transportation (FDOT) annually executed Agreements for the maintenance, mowing and litter removal along U.S. 41 between Salford Boulevard and Ortiz Boulevard. In accordance with these Agreements, FDOT disbursed quarterly lump sum payments to the City of North Port. The services to be rendered by the City of North Port commenced subsequent to the execution of the corresponding Agreement upon written notice from the FDOT Project Manager and continued for one year from the date of said Notice.

During the Road and Drainage District Governing Body Meeting held on November 24, 2020, the Commission approved Resolution No. 2020-R-42 entering into a Maintenance Agreement with FDOT (BEA29) for a three-year Agreement with a three-year renewal. Agreement No. BEA29 expires on December 14, 2023.

In lieu of renewal, FDOT has requested the execution of a new Agreement for these services. Each year FDOT evaluates the statewide averages and adjusts activities based on the prior year's averages. This Agreement will bring the pricing more in line with the statewide averages.
