Recommended Action
Discussion and possible action regarding the City Manager's annual evaluation and amending the City Manager's Employment Agreement relating to the Agreement term, and notice requirements for termination and resignation.
Background Information
Pursuant to the City Manager's Employment Agreement, Article II, Section G (2), the City Commission must conduct an initial performance evaluation of the City Manager annually during the month of September at a public meeting. The City Manager has provided a self-evaluation for the Commission which is included along with the Commissioners' evaluations for consideration of compensation adjustments based on the results of the Employee's annual performance evaluations.
The current City Manager's Employment Agreement is for a term of four years, it also states the City Manager will be deemed terminated without cause, effective thirty (30) days following a terminating event. The City Manager is seeking direction from the Commission for the City Attorney's Office and the Office of Human Resources to draft an amendment to these terms of the contract for the Commission's future consideration.

Financial Impact
Per Article II, Section 6 (2) of the Agreement, the Commission may consider adjustments to compensation based on the results of the performance evaluation. Funding for any potential increase will be included in the Fiscal Year 2023 budget in account no. 001-0800-512-1100.
