Based on evidence presented, Hearing Officer Toale dismissed Case No. 21-4490
3955 Fairchild Avenue, regarding the violation of Section 45-5A, Unified Land
Development Code (ULDC) due to the tree in question being cut prior to 2017 when
the current owner moved in, and the Tree Ordinance not being effective until
2019-2020.

21-4503 concurrently, noted property was inspected initially on October 12, 2021, the
number of trees removed was undetermined, both lots are 10,000 square-feet, submitted
photos into evidence, and had contact with the contractor.
Based on evidence presented, Hearing Officer Toale found Case No. 21-4501 3767
Lothair Avenue, to be in violation of Section 45-5A, Unified Land Development
Code (ULDC) for removing an unknown number of trees with no permit on a 10,000
square-foot lot, and imposed a fine of $2500.

Based on evidence presented, Hearing Officer Toale found Case No. 21-4503, 3767

Development Code (ULDC) for removing an unknown number of trees; that even
though the contiguous tax parcel is 50,000 square-feet the tree removal was only
done on one of the platted lots with the total impacted area of 10,000 square-feet,
and imposed a fine of $2500.
