Recommended Action

 

Discussion and possible action to direct staff to conduct a reconciliation of the Art Fund.

 

Background Information

 

During the City Commission Regular Meeting held on June 14, 2010, the City Commission adopted Ordinance 2010-14, amending the Unified Land Development Code which included a new Chapter 59 - Public Art Regulations and associated fees.

 

During the City Commission Regular Meeting held on April 26, 2022, discussion took place regarding prior Commission discussion and action; incentivizing developers to purchase and place art; incentive percentage considerations, and art fund balance.  At the conclusion of their discussion, the following actions were taken by the Commission:

 

Ø                     A motion was made to approve the Commission agreements from the December 8, 2020, formula to calculate, adding a 25% incentive for developers if they place the art themselves.

 

Ø                     A motion to amend was made to add "and direct the City Manager to work with the City Attorney and Staff to bring back an Ordinance for first reading.”

 

Since 2010 there has been considerable growth and development within City activity centers. Comparing the rate of growth, Commissioner McDowell noticed very little art in the activity centers.  In addition, the Art Fund appeared to be low in comparison to the contribution requirements.   (See attached Art Fund balance, as of March 31, 2022).  On April 21, 2022, Commissioner McDowell requested a breakdown of the money received for the past three years to include the name of each development; the amount contributed; and the date of contribution.  She also requested a list of developers who installed their own art during the past three years.  Due to the amount of staff time necessary to conduct the research, the City Manager will need direction from Commission to proceed with the Commissioner’s request for staff to compile this information.
