TITLE: Approval of a Content Release form for Visit Florida to utilize the City's provided photographs.


Recommended Action

Approve Visit Florida's Content Release form to allow Visit Florida exclusive rights to use and share the City of North Port's photographs to promote the State of Florida and the City of North Port to visitors.

Background Information

On December 14, 2017, it was discovered that the City of North Port was not listed as one of the cities in Southwest Florida on VisitFlorida.com, the State of Florida's tourism website. Staff contacted Visit Florida to understand the process for being listed on the website and determine how the City of North Port could be added.

On January 10, 2018, a representative from Visit Florida responded to the City of North Port's inquiry and explained that at least 10 tourism-related businesses (from same City) needed listings on Visit Florida in order for a city or community to be placed on the Visit Florida website. North Port had nine business listings. However, Visit Florida agreed to waive the policy of 10 listings and allow the City to be listed.

As part of the process, the City has been asked to provide a signed Content Release, several photographs, and a short description that Visit Florida can use as content for its webpage.

The Content Release form, which has been reviewed by the City Attorney's Office as to form and correctness, needs City Commission approval as the City will be granting Visit Florida non-exclusive, perpetual, worldwide license to use, share and modify the City of North Port's photographs and content to promote the State of Florida and the City of North Port to visitors. This includes giving the rights to Visit Florida's third parties to use the photographs.
