Recommended Action

Approve the City of North Port, Florida and Sarasota County, Florida Water and Wastewater System Interlocal Agreement

Background Information

Sarasota County has requested that the City provide water and wastewater services to the recreational property on US41, also known as the Senator Bob Johnson's Landing property. While this property is in the County, only the City has existing lines by which the property could be served. Due to the unique location, it is anticipated this property will provide opportunities for a range of outdoor recreation including canoe/kayak launching, nature trails, picnicking, fishing, and rowing. Sarasota County will design, permit, and construct all necessary improvements to connect the site to the City's existing water and wastewater system and dedicate all off-site improvements to the City. It is anticipated that the Interlocal Agreement will be on Sarasota County's agenda on February 13, 2017 as well.

The County has entered into an Assignment and Assumption Agreement and an ERC Purchase Agreement, attached as Exhibit A-4 to the Interlocal Agreement, with Thomas Ranch Intangibles, LLLP to purchase 2 ERCs from them, which will be sufficient to serve the property.

The agreement has been approved as legally correct as to form by legal.

Financial Impact

All project costs will be borne by the County and once constructed, the City will gain a new water and wastewater customer. In addition, the County shall convey ownership and control to the City of the off-site facilities.
