Recommended Action

Approve Third Amendment to Cooperative Funding Agreement No. 16CF0000171 between the Southwest Florida Water Management District (SWFWMD) and the City of North Port for City of North Port Best Management Practices (BMP) Alternatives Analysis (N682) to extend expiration date to December 31, 2019.

Background Information

The SWFWMD and the City of North Port entered into an Agreement for a BMP Alternatives Analysis Study to develop feasible solutions to reduce flooding within the City. The expiration date of the original Agreement was September 1, 2017. The First Amendment to the Agreement extended the expiration date to April 30, 2018. The Second Amendment to the Agreement extended the expiration date to April 30, 2019. The Third Amendment will extend the expiration date to December 31, 2019.

Several meetings were held with the City of North Port, Sarasota County and SWFWMD to discuss feasible options for flood reduction within the City. As such, due to the time constrains necessary to coordinate and conduct these meetings, the Agreement deadline was not able to be met. During the City Commission Special Meeting held on December 6, 2018, the Commission approved the recommended flood reduction plan with phased components, however, to not proceed with the bypass relief canal without extensive historical and archeological environmental research done first. Staff will submit a Conceptual Environmental Resource Permit (ERP) to the SWFWMD for review and approval following the City Commission meeting on March 4, 2019 if that is the Commission's consensus.
