TITLE:                     Ordinance No. 2018-56, First Reading, Amending ULDC Chapter 55, Section 55-15 and Section 55-16 to Allow Pawn Shops in Activity Center 1, TXT-18-230

Recommended Action

City Commission continue Ordinance No. 2018-56 to second reading on January 22, 2018.

Background Information

At the October 9, 2018 City Commission meeting, Commission directed staff to draft language removing the prohibition of pawn shops in Activity Center 1 and adding pawn shops as a permitted use in Activity Center 1.

This ordinance would strike current language in ULDC Chapter 55, Sec. 55-16 Prohibited uses listing pawn shops as a prohibited use and amend ULDC Chapter 55, Sec. 55-15 Permitted uses to add pawn shops as a permitted use in Activity Center 1, Mediterranea.

At the December 6, 2018 Planning and Zoning Advisory Board meeting there was discussion on this item about allowing pawn shops to locate in Activity Center 1. Board members expressed the opinion that pawn shops should remain where they are already allowed to locate and should remain existing, non-conforming in Activity Center 1. The vote to recommend approval was 2-2, and it failed for lack of majority.

The City Attorney reviewed and approved Ordinance 2018-56 as to form and correctness.
