Recommended Action
Approve Ordinance 2017-44 amending City of North Port Administrative Code, repealing Chapter 34, Article III - Vehicle for Hire, in its entirety providing for conflicts; providing for severability; and providing for an effective date.
Background Information
The Administrative Code of the City of North Port, Florida, Chapter 34, Article III provides for licenses, permits and miscellaneous business regulations regarding vehicles for hire. On February 26, 2016, the previous Commission discussed the vehicle for hire ordinance and the need for amending such ordinance as it related to background investigations of drivers. Staff reviewed numerous options and completed the requested amendment to the ordinance with the appropriate verbiage to address the concern.
However, subsequent to such a meeting, Florida Law 2017-12 created Section 627.748, Florida Statutes, effective July 1, 2017, that applies to transportation network companies, as that phrase is defined in Section 627.748(1), preempting local regulation of transportation network companies. Given the revised Florida Statutes, the City finds it advisable to repeal Chapter 34, Article III - Vehicles for Hire, in its entirety.
This item was heard for first reading on November 28, 2017. Commission approved the continuation of the Ordinance to the December 12, 2017 meeting for second reading and adoption.
