Background Information
Currently, the City's procurement code does not have a mechanism for accepting, reviewing and evaluating unsolicited proposals for a P3. To promote the efficient and effective use of the P3 method of project delivery, it is necessary to adopt uniform procedures for the procurement of such projects.
At its December 11, 2018 regular meeting, the City Commission considered Ordinance No. 2018-59. Special counsel Frederick J. Springer of Bryant, Miller, Olive presented information and answered questions about public-private partnerships (P3s). The City Commission voted to continue the ordinance to another first reading with certain changes directed.
At its January 8, 2019 meeting, the City Commission again considered Ordinance No. 2018-29. The City Commission voted to continue the ordinance to an evening meeting with certain changes directed:
1. Move all referenced fees to the City's fee schedule;
2. Require conceptual proposals to come before Commission for approval and if not approved officially, review fees will be reimbursed;
3. Set a review fee for solicited proposals based on the advice of outside counsel, using the same market data as used for other fees within the ordinance;
4. Reorder Sec. 2-420(b)(3) to become (1);
5. In Sec. 2-420(c)(4), change "should" to "must"; and
6. Correct the dates of the public hearings appearing before the signature blocks.
