Recommended Action

Approve the Equitable Sharing Agreement and Certification between the U.S. Department of Justice and the U.S. Department of the Treasury and the City of North Port.

Background Information

The Federal Equitable Sharing Agreement entered into between the Federal Government and the City of North Port sets forth the requirements for participation in the Federal Equitable Sharing Program and the restrictions on the use of federally forfeited cash, property, proceeds, and any interest earned thereon, which are equitably shared with participating law enforcement agencies. By submission of this signed agreement the City of North Port agrees that it will be bound by the statutes and guidelines that regulate shared assets and the listed requirements for participation in the U.S. Department of Justice and the U.S. Department of Treasury Equitable Sharing Program.

In accordance with such agreement, the City of North Port must report any activity on an annual basis. For FY 2022, the City of North Port did not receive any federal funds from the Department of Treasury, and nothing was expended. The receipt of the signed Equitable Sharing Agreement and Certification that is attached is a prerequisite to receiving any equitably shared cash, property, or proceeds.

The attached document has been reviewed and approved for form and correctness by the City Attorney.

Failure to submit the agreement and certification will result in the City becoming ineligible for equitable sharing funds.
