TITLE: Discussion and Possible Action Regarding the Approval of Annual Budgets and Budget Amendments by Resolution or Ordinance
Recommended Action
I move to direct staff to draft a (resolution or ordinance) for the approval of the Non-District Budget and budget amendments.
Background Information
For fiscal year 2021-2022, Commission approved the non-district budget by resolution, with direction that all non-district budget amendments be handled in the same format as approval by ordinance.
The City Attorney provided the below:
• Municipalities may fix millage rates by resolution or ordinance. See Fla. Stat. § 200.001.
• Municipalities may adopt budgets by resolution or ordinance. Amendments should be made by the same type of instrument use to adopt the budget. See Fla. Stat. § 166.241(2).
• Florida Statutes require that special districts adopt budgets by resolution. Two budget hearings must be conducted, one for the tentative budget and one for the final budget. See Fla. Stat. § 189.016(3).
Staff is requesting Commission direction regarding whether to approve the annual non-district budget by ordinance or resolution.
