Discussion and possible action regarding revisions to Chapter 4, Boards and Committees, Article I. - Boards Generally of the Code of the City of North Port, Florida.

Background Information

During the City Commission Regular Meeting held on February 14, 2023, the Commission adopted Ordinance 2023-07, repealing and replacing Chapter 4, Boards and Committees, Article I. - Boards Generally of the Code of the City of North Port, Florida, which states:

Section 4.3 Appointment, qualifications, term and vacancies

(e) Removal
...
(2) A board member will be deemed to have resigned the member's seat if the board member has three absences from regular meetings within a 12-month period.

The Planning and Zoning Advisory Board (PZAB) is statutorily required to hear land use issues including Unified Land Development Code Ordinances. Part I - Charter, Article V. - City Commission Authorities, Sec. 5.06.- Advisory boards and committees (b) 1 of the Code of the City of North Port, Florida, states:

(b) The City Commission shall always maintain the following Advisory Boards:

1. Planning and Zoning Advisory Board

The allowance of three absences per year is too restrictive for the PZAB due to their meeting schedule. Staff recommends that Part I - Charter, Article V. - City Commission Authorities, Sec. 5.06.- Advisory boards and committees (b) 1 of the Code of the City of North Port, Florida, should be amended to allow PZAB additional absences to prevent unintended consequences due to lack of members to timely fulfill their duties.
