Background Information

Impact fees are charged on new development based upon the burden placed on City services and for a proportionate share of the cost of providing additional infrastructure available for use by new growth. Chapter 58 of the Code of the City of North Port, Florida, establishes the City's impact fees.

The City's current impact fees were created in an Impact Fee Study prepared by Tindale-Oliver & Associates, Inc. and dated September 13, 2011. The City Commission previously determined that the methodology and rates contained in the Impact Fee Study were valid based upon the most recent localized data as required by Section 163.31801, Florida Statutes (the "Florida Impact Fee Act").

The current fees were raised effective June 11, 2019, and are charged at a rate of 75 percent of what the Study justifies. On September 22, 2020, the City directed staff to bring back an Ordinance to raise the impact fees to 100 percent of the 2011 Impact Fee Study and bring the following items as backup:

* Impacts to individual fee categories (Attachment 2).
* Comparison to area neighbors, including Charlotte, DeSoto and Sarasota Counties as well as municipalities; include date of most recent Study and adoption date of current fees (Attachment 3).
* Impact to an individual mortgage and commercial loan (See table below).



The Florida Impact Fee Act provides that when increasing impact fees, 90 days' notice must be provided by advertisement. This Ordinance will be properly advertised for second reading to meet that requirement. Ordinance No. 2020-42 ...
