SUBJECT: A Resolution of the City Commission of the City of North Port, Florida, Approving the Termination and Conveyance of Easement Agreement for Utility and Drainage Easements Located on Lots 1, 2, 3, and 4 of Block 349, of the 3rd Addition to Port Charlotte Subdivision, as Recorded in Plat Book 11, Pages 31, 31a-31d of Sarasota County Florida Official Records; Providing for Incorporation of Recitals; Providing for Approving Agreement; Providing for Recording; Providing for Conflicts; Providing for Severability; and Providing an Effective Date.
Recommended Action
City Commission approve Resolution No 2023-R-43.
Background Information
The property owner of Lots 1, 2, 3 & 4, Block 349, of the 3rd Addition to Port Charlotte Subdivision applied for relocation of easements (ROE-22-165). On September 16, 2022, upon review and based on the documents submitted, the City of North Port thereby relocated the Utility and Drainage easement as per Unified Land Development Code (ULDC 53-267). Despite the recorded ROE, the title company involved in FTR Properties, LLC's sale of the property to First One South of the Border, LLC, is requiring approval of a Termination and Conveyance of Easement Agreement.
Resolution 2023-R-43 has been reviewed by the City Attorney and is legally correct as to form.
