TITLE: Approve the Eleventh Amendment to Construction Manager at Risk Contract No. 2023-17.001 for Construction Services Contract Phase II With Wharton-Smith, Inc., in the Amount of $766,936.00, for Repair/Demolition Services at the Public Services Facility Site Located at 5455 Pan American Boulevard.


Recommended Action

Approve the Eleventh Amendment to Construction Manager at Risk Contract No. 2023-17.001 for Construction Services Contract Phase II with Wharton-Smith, Inc., in the amount of $766,936.00, for repair/demolition services at the Public Services Facility site located at 5455 Pan American Boulevard.

Background Information

The Public Services Facility site, consisting of multiple structures including the Parks and Recreation Maintenance Facility and the Solid Waste Recycling Station, sustained significant damage from Hurricane Ian that requires both repair and demolition services. This includes, but is not limited to:

> Demolition of the former Parks and Recreation Maintenance Facility.

> Roof repairs of the garage utilized by the Department of Utilities.

> Removal of damaged structures such as a Parks shed, former guard shack, Utilities storage shed, and a decommissioned generator.

> Replacement cover to the Solid Waste Quonset hut, and site fencing.

Staff continues to work with representatives from the Federal Emergency Management Agency, (FEMA), Rostan Solutions, Inc., and the City insurance provider, Halliwell, to identify funding availability for reimbursement of this project.

Upon evaluation of the project, the use of the Construction Manager at Risk (CMaR) Continuing Services Contract has been identified as the most expedient path to complete this project. The CMaR contracting process includes the following two phases:
