Approve the Settlement Agreement and Release between Victor Ramos and the City of North Port.
Background Information
The following provides a chronological order of events pertinent to the Settlement Agreement and Release between Victor Ramos and the City of North Port:
> February 3, 2022: Victor Ramos sustained bodily injury due to a motor vehicle accident with a City of North Port vehicle.
> October 24, 2024: The parties reached a tentative Settlement Agreement, subject to City Commission approval. The tentative Settlement Agreement coincides with the sovereign immunity limits pursuant to Florida Statute 768.28. The tentative Settlement Agreement has been reached to avoid the time, expense, and potential exposure to a claims bill, at the recommendation of the City's excess insurance carrier, Preferred Governmental Insurance Trust.
Ordinance No. 2015-43, Section 3: SETTLEMENT OF CLAIMS states:
"The City Manager, with the advice of the City Attorney and staff, will have the authority to consider and settle all claims that are made against the City or by the City in an amount not to exceed one hundred thousand dollars ($100,000). All claims that are made against the City or by the City in an amount exceeding one hundred thousand dollars ($100,000) will be presented to City Commission for discussion and authorization to settle."
The Settlement Agreement and Release between Victor Ramos and the City of North Port has been reviewed by the Interim City Attorney and is legally correct as to form.
