Recommended Action

Staff recommends to the City Commission approval of Petition No. VAC-22-197 via Resolution 2023-R-30.
General Information

Hans Menzer of Flamingo Pool & Spa, Inc., on behalf of the property owners Daniel and Cynthia Mora, has formally submitted to the City of North Port a written petition to request a partial vacation of the platted rear 20-foot maintenance easement located on Lot 16, Block 248, 8th Addition to Port Charlotte Subdivision. The purpose of the vacation request is to allow the newly constructed pool deck, and cage to encroach into the 20-foot rear maintenance easement.
The subject property is developed and located at 2296 Sadnet Lane and encompasses approximately 0.728 acres.
Pursuant to Florida Statutes Chapter 177.101, an application has been made to the City of North Port to formally request a vacation of a portion of the platted rear 20-foot maintenance easement located on Lot 16, Block 248, Eighth Addition to Port Charlotte Subdivision.
A legal notice of intent to vacate the easements was published by the property owners in a newspaper of general circulation for two (2) weeks consecutively.
The affected utility agencies have been notified of the vacation request and, through written responses, have granted their approval.
The City Attorney has reviewed and approved Resolution 2023-R-30 as to form and correctness.
