Background Information
On November 14, 2020, Mayor Luke made a motion to elect Commissioner McDowell as Vice Mayor. This motion passed 3:2 with Commissioner’s Emrich and Langdon dissenting. Mayor Luke did not pass the gavel in accordance with City Code Section 2-61(2)(b), making the vote null and void.
According to Robert’s Rule of Order Section 39:5 states that improper motions are motions that conflict with the corporate charter, constitutions, or bylaws of a society, or with procedural rules prescribed by national, state, or local laws, are not in order, and if any motion of this kind is adopted, it is null and void.
Section 2-61(b)(2) of the City Code states “Mayors ability to vote. In accordance with city charter section 5.03, the mayor shall have a voice and a vote on all questions and items and is called last. The mayor may move to make motions upon passing the gavel to the vice-mayor or, in the absence of the vice-mayor, to any commissioner.
