Discussion and Possible Action Regarding the First Amendment to the City Manager's Employment Agreement.

Background Information

During the City Commission Regular Meeting held on September 26, 2023, a motion was made to direct the City Attorney to draft amendments to the City Manager's contract relating to term and notice requirements for termination and resignation. The City Attorney prepared the amendment as described below. The City Manager reviewed the proposed amended contract and presented no objection to the language as drafted.

Term

Article I, Section B of the City Manager's Employment Agreement provides a term of four years, beginning October 1, 2021, and expiring on October 1, 2025, unless otherwise terminated.

If amended as presented, the Agreement will have an initial term running from October 1, 2021, through September 30, 2023, followed by a second term from October 1, 2023, through September 30, 2024. At the end of the stated term, the Agreement will automatically renew annually every October 1st, unless otherwise terminated.

Termination/Resignation

Article VI, Section A of the City Manager's Employment Agreement provides that if the City Manager voluntarily resigns, his employment will be deemed terminated upon the date specified in his notice of resignation or an earlier date as determined by a majority vote of the City Commission.

If amended as presented, the City Commission may continue to determine by majority vote that an earlier effective date of termination shall apply upon the City Manager's resignation. However, the earlier effective date must be at least 30 days from the date of the City Manager's written notice of resignation.
