TITLE: Approve the Memorandum of Understanding for Law Enforcement Agency Access to Driver and Vehicle Information Database System (DAVID) Between the City of North Port and the Florida Department of Highway Safety and Motor Vehicles


Recommended Action

Approve the Memorandum of Understanding for Law Enforcement Agency Access to Driver and Vehicle Information Database System (DAVID).

Background Information

The Florida Department of Highway Safety and Motor Vehicles (DHSMV) collects and maintains a database system referred to as DAVID. Officers utilize this system to access and transmit driver and vehicle information, emergency contact information, insurance information, and other personal information necessary to perform day to day operations within the Police Department. In 2016 the City executed a Memorandum of Understanding (MOU) with the DHSMV for access to the DAVID System which is set to expire in December 2022.

In addition to the MOU, an Annual Certification Statement is attached for approval certifying that the Agency has adequate controls in place to protect personal data from unauthorized access, distribution, use, modification, or disclosure, and is in full compliance with the requirements of the proposed MOU. Quarterly audits and other control measures concerning the usage of DAVID by North Port Police Department staff are performed regularly by the Accreditation Administrator and reported as needed. The Accreditation Administrator maintains a file of the audits performed for access by the Florida Department of Highway Safety and Vehicles Field Liaisons.

This MOU shall take effect upon the date of last signature by the parties and shall remain in effect for six (6) years from this date unless sooner terminated or cancelled in accordance with Section IX, Termination. Once executed, this MOU supersedes all previous agreements between the partie...
