Recommended Action

Approve Resolution No. 2022-R-09, granting a vacation of a portion of the platted rear twenty-foot (20) maintenance easement on Lot 27, Block 1608, Thirty-Second Addition to Port Charlotte Subdivision.

General Information

David and Chrissy Bucko, the property owners, are petitioning the City of North Port to grant a vacation of a portion of the platted rear twenty-foot (20') maintenance easement on Lot 27 to allow a newly constructed pool, pool deck, and screened enclosure to remain. The property is currently a single-family residence. There are no active building permits on the site.

Pursuant to Florida Statutes Chapter 177, an application has been made to the City of North Port to formally request to vacate a portion of the platted rear twenty-foot (20') maintenance easement on Lot 27, Block 1608, Thirty-Second Addition to Port Charlotte Subdivision.

A legal notice of intent to vacate the easements was published by the property owners in a newspaper of general circulation for two (2) weeks consecutively.

The affected utility agencies have been notified of the vacation request and through written responses, have granted their approval.

The City Attorney has reviewed the accompanying Resolution 2022-R-09 as to form and correctness.

The Planning and Zoning Advisory Board heard this item at their regular meeting on January 6, 2022. The Board voted 3-0 to recommend approval of Resolution 2022-R-09, VA...
