Recommended Action

Option 1: Discussion regarding the City Attorney’s annual performance evaluation, with action to approve a compensation adjustment.

City Commission Options

Option 1: Discussion regarding the City Attorney’s annual performance evaluation, with action to approve a compensation adjustment.

Pros: Fosters a culture of recognition and appreciation; allows for competitive compensation for experience and knowledge; and allows for increased job satisfaction.
Cons: Encumbers funding that could be utilized elsewhere.

Option 2: Discussion regarding the City Attorney’s annual performance evaluation with no compensation adjustment.

Pros: Allows funding to be utilized elsewhere.
Cons: Decrease in job satisfaction and competitive compensation.

Background Information

Pursuant to Article II. Section I.2. of the City Attorney Employment Agreement, effective October 15, 2025:

… the City Commission must conduct a performance evaluation of Employee at a public meeting annually during the month of September, subject to a process, form, criteria, and format that are consistent with Employer's practices for its Charter Officers, and which shall be mutually agreed upon by the Employee and the City Commission. The City Commission may consider compensation adjustments based on the result of Employee's annual performance evaluations, effective on the anniversary of this Agreement's Effective Date and in accordance with the annual budget appropriations of Employer.
