TITLE:                     Authorize the Execution of a Notice Incorporating the Injection Well, Monitoring Wells, and Related Improvements into the Property Warranty Deed for the Southwest Wastewater Reclamation Facility

Recommended Action

Authorize the execution of a Notice incorporating the injection well,  monitoring wells and related improvements into the property Warranty Deed for the Southwest Wastewater Reclamation Facility.

Background Information

On March 25, 2020, Commission approved Resolution No. 2020-R-07, accepting the transfer of ownership of the Southwest Wastewater Reclamation Facility (SWWWRF) from the West Villages Improvement District to the City of North Port. The conveyance of this facility included a deep injection well and two monitoring wells located on the property.

Florida Department of Environmental Protection (FDEP) Statute 62.528.455 requires that certification of the location of the wells on the property be recorded with the Warranty Deed for the well operating permits. Utilities is requesting the execution of the Notice, with Exhibits, which signifies the location of the wells in order to fulfill this requirement and maintain compliance with the FDEP operating permit.

Legal has reviewed the Notice and it has been approved as to form and correctness.
