TITLE: Approve the Water and Wastewater Utility Developer Agreement Between the City of North Port and Bristol Edward Rudolf Revocable Trust.
Recommended Action
Approve the Water and Wastewater Utility Developer Agreement between the City of North Port and Bristol Edward Rudolf Revocable Trust.
Background Information
Brad Baker, the Trustee of the Bristol Edward Rudolf Revocable Trust, has expressed desire to enter into a Utility Developer Agreement with the City of North Port for property located at the northwest quadrant of River Road and U.S. 41. The property is located within the U.S. 41 corridor improvement area, which would be subject to additional fees as outlined in the Agreement and in accordance with Chapter 78, Utilities, Sec. 78-31. (a)(4). - Responsibility for collection, distribution and transmission costs of the Code of the City of North Port, Florida. The associated Agreement requires Commission approval as it falls outside the Standard Agreement previously approved.
The Water and Wastewater Utility Developer Agreement between the City of North Port and Bristol Edward Rudolf Revocable Trust has been reviewed by the City Attorney and is legally correct as to form.

Financial Impact
Guaranteed revenues will begin to accrue per each reserved unit of capacity from the date of first payment until connection to the system. The current monthly guaranteed revenue rate is equivalent to the water and/or wastewater base facility charge.
