Background Information
On December 8, 2021, Commission approved Ordinance No. 2020-40 which restated and amended sections of the Road Maintenance Rehabilitation Program in Chapter 66, Article III. Section 66-71 - Fee Waiver added a process for Waiver of the Construction Traffic Road Fees which included having a contract between the applicant and the City.
This Agreement for Waiver of Construction Traffic Road Fees established an agreement template to use for all applicants that have met the required criteria and are approved for the fee waiver. As the process for Waiver of Construction Traffic Road Fees is explicitly laid out in the Ordinance, which was approved by Commission, establishing an agreement template, and authorizing the City Manager or designee to sign future agreements using the approved template provides for an efficient and effective process.
Legal has reviewed the agreement template and has approved as to form and correctness.
