Recommended Action

 

Approve Resolution No. 2022-R-63 Approving the Two Subordinations of City Utility Interests Along the South Side of Tamiami Trail in Wellen Park for the Florida Department of Transportation for Highway Purposes.

 

Background Information

 

The Florida Department of Transportation (FDOT) has requested two Subordinations of Utility Interests for FDOT parcels 803.4 and 804.5 that relate to a portion of two City utility easements. Sidewalks are being constructed in these areas, which will require the subordinations. This will still allow the City of North Port Utilities Department to construct, operate, maintain, improve, add to, upgrade, remove and relocate facilities on or within the FDOT right of way of US 41 as well as provides FDOT access to the easements for highway purposes and sidewalk maintenance.

 

Resolution No. 2022-R-63 has been reviewed by the City Attorney and is legally correct as to form.
