Recommended Action

 

Approve Resolution No. 2022-R-59, A Resolution of the City Commission of the City of North Port, Florida, Approving the Subordination of City Utility Interests in Favor of the Florida Department of Transportation for Highway Purposes.

 

Background Information

 

On July 26, 2022, the City Commission approved the first of two subordinations at the same general location. The Subordination of City Utility Interests Agreement between State of Florida Department of Transportation (FDOT) and the City of North Port allows the City of North Port Utilities Department to construct, operate, maintain, improve, add to, upgrade, remove, and relocate facilities on or within the FDOT right of way of US 41 as well as provides FDOT access to the easements for highway purposes.

 

Resolution No. 2022-R-59 has been reviewed by the City Attorney and is legally correct as to form.
