Approve Resolution No. 2025-R-29.
Background Information
The North Port Police Department has legal authority under the Florida Contraband Forfeiture Act (Florida Statutes
932.701 - 932.7062) to seize and initiate forfeiture actions against property involved in unlawful activities. Under the same Act, the City Commission of the City of North Port has the authority to negotiate and enter into Settlement Agreements concerning forfeiture matters.
As a result of entering into an Agreement, the cost, delay, and uncertainty of litigation to the parties would be avoided. The City would not initiate a forfeiture action, and the Claimant would waive any and all rights under the Act. Once the template is approved, the City Manager or designee would be able to sign all subsequent Settlement Agreements without further Commission approval.
Resolution No. 2025-R-29 has been reviewed by the Interim City Attorney and is legally correct as to form.
