TITLE: Ordinance No. 2016-38, First reading, An Ordinance of the City of North Port, Florida, amending the City of North Port Administrative Code, Chapter 42, Nuisances; Amending Section 42-21 Excessive Growth; Dead Trees.

Recommended Action

Approve and continue to second reading, Ordinance 2016-38, An Ordinance of the City of North Port, Florida, amending the City of North Port Administrative Code, Chapter 42, Nuisances; Amending Section 42-21 Excessive Growth; Dead Trees.

Background Information

In February 2013, City Commission approved Ordinance 2012-27, an ordinance that amended North Port City Code 42, Nuisances; amended Section 42-21, Excessive Growths; Dead Trees. The ordinance eliminated services, provided by the City, for impinging growth removal between private properties and the removal of dead trees on private properties and by default placed the responsibility on the offending property owner.

During FY 2016-17 budget hearings/workshops, Commission expressed wanting to have the City Code revised to allow for code enforcement when growth impinges from one property to another. Consequently, Ordinance 2016-38 has been drafted to return the language previously found in Chapter 42 prior to the enactment of Ordinance 2012-27, as well as recommended language to further clarify property owner's responsibilities. The amended ordinance will allow the City to issue a notice for violation of code for impinging growth between private properties as well as dead trees on private property. Should the property owner, receiving the notice of violation, not rectify the violation in the time provided the City can take action to have the impinging growth and/or dead tree removed and lien the respective property for the cost.
