Recommended Action
Direct Staff to draft ordinance amending Sections 66-33, 66-60, and 66-87 of the City’s Code of Ordinances to reflect meeting notification requirements to be filed and published on a quarterly, semiannually or annual basis in a newspaper of general circulation, consistent with Florida Statute 189.015 and to remove the additional requirement to be advertised at least seven days before the meeting in a newspaper of general circulation.
Background Information
FS 189.015 requires special district regular meetings to be filed and published on a quarterly, semiannually or annual basis in a newspaper of general circulation.
Currently the City’s Ordinance requirements are that the Fire Rescue District and Road and Drainage District Meetings are to be published annually in a newspaper of general circulation with an additional requirement to be advertised at least seven days before the meeting in a newspaper of general circulation. The City’s Ordinance does not annotate any advertisement requirements for Solid Waste District meetings. Prior to July 2019, the City has not been noticing the district meetings in accordance to the Code of Ordinances. A request for legal services was submitted and is provided in the back up material.
In order for all three code sections to be consistent with FS 189.015, each should require notices to be published quarterly, semiannually or annual basis in a newspaper of general circulation.
