Recommended Action
 
Appoint James E Toale, Esquire as Zoning Hearing Officer of the Unified Land Development Code.
 
Background Information
 
The City Commission requested proposals for Zoning Hearing Officers.  The solicitation period was during the month of February.  Two proposals were received: Jed R. Schneck, Esquire, and James E Toale, Esquire.
 
To be eligible for service as a Hearing Officer, Section 1-32.A. (2) (b) of Ordinance No 2014-29 states: a person must be engaged in the practice of law in Sarasota County or be a resident of the City.  Jed Schneck's law firm is incorporated in Boca Raton Florida.  His proposal does not suggest a practice in Sarasota County.
 
James Toale is 'Of Counsel' to Tannenbaum Hanwich in the city of Sarasota, Florida.  His proposal suggests his entire practice is in Sarasota County.
 
The evaluation forms of the proposals along with each proposal are attached as backup.  
 
Section 1.32.A. of Ordinance No. 2014-29 provides. "Hearing Officers shall be compensated at a rate to be determined by the city commission".  Mr. Toale offers his services at $195.00 per hour.
