TITLE:                     A Resolution of the City of North Port, Florida, Accepting the Transfer of Water and Wastewater Infrastructure and Improvements and Associated Warranties in Sunstone Village F3; Providing for Incorporation of Recitals; Providing for Filing of Documents; Providing for Conflicts; Providing for Severability; and Providing an Effective Date.

 

 

Recommended Action

 

Approve Resolution No. 2025-R-27 as presented.

 

Background Information

 

On September 10, 2019, the City of North Port and West Villages, LLLP and West Villages Improvement District (“WVID”) entered into an Amended and Restated Utilities Agreement (“Agreement”), requiring the WVID to pay for the construction of and transfer ownership and control to the City of certain on-site and off-site water distribution and wastewater collection systems. West Villages, LLLP and West Villages Improvement District have constructed infrastructure improvements as outlined in the Agreement.

 

The infrastructure located within Sunstone Village F3 is now complete, therefore, this Resolution is necessary to identify what infrastructure the City is accepting from the developer. The City holds easement rights to access, operate, and maintain the infrastructure and all related warranties have been assigned to the City.

 

Resolution No. 2025-R-27 has been reviewed by the City Attorney and is legally correct as to form.
