TITLE: A Resolution of the City of North Port, Florida, Accepting the Transfer of Water and Wastewater Infrastructure and Improvements and Associated Warranties in Heron Creek, Phase 2; Providing for Incorporation of Recitals; Providing for Filing of Documents; Providing for Conflicts; Providing for Severability; and Providing an Effective Date.
Recommended Action
Approve Resolution No. 2025-R-31 as presented.
Background Information
On April 25, 2023, the City of North Port and North Port MF Ventures, LLC, (“Developer”) entered into a Water and Wastewater System Standard Developers Agreement requiring the Developer to construct and transfer certain water and wastewater systems to the City. North Port MF Ventures, LLC has constructed infrastructure improvements as outlined in the Agreement.
The infrastructure located within Heron Creek Phase 2 is now complete, therefore, Resolution No. 2025-R-31 is necessary to identify what infrastructure the City is accepting from the developer. The City holds easement rights to access, operate, and maintain the infrastructure and all related warranties have been assigned to the City.
Resolution No. 2025-R-31 has been reviewed by the Interim City Attorney and is legally correct as to form.
