TITLE: Approve Termination and Release of Easement in Favor of Main Street Ranchlands, LLLLP Related to the Utility Easements in the Wellen Park Downtown Development
Recommended Action
Approve the request to terminate two force main easements recorded on instrument ORI 2007158249 and ORI 2007158250 and retain the lift station easement ORI 2007158246 and Ingress/Egress Easement ORI 2007158251.
Background Information
The Village D, VDPP and Downtown plans have always anticipated that the existing lift stations and force mains would be removed and replaced with other sanitary sewer system improvements, which run within the planned downtown roadway rights-of-way or if needed within easements immediately adjacent to said rights-of-way. Currently the force main easements are located in the area where the grand lake is planned for construction. Removing the two force main easements would allow for the unencumbered construction of the grand lake which is a main amenity and focal point for the downtown area. The force main easements are not platted easements but have been recorded on instruments ORI 2007158249 and ORI 2007158250. Terminating these easements would not have an impact on the Wellen Park Downtown Phase 1 Plat.
The Utilities Department has reviewed the request to terminate the two force main easements and has requested the lift station easement and access easement remain at this time as the City is still maintaining the lift station and upstream manholes for the service to the office building off of West Villages Parkway. These easements (ORI 2007158246 - lift station; ORI 2007158251 - access) are shown on the Wellen Park Downtown Phase 1 Plat, PLF-20-100 and will be recorded with the plat after the plat is approved by the City Commission. The plat is scheduled to be heard by the Commission at the October 27, 2020 meeting.
