Recommended Action

Approve Resolution No. 2022-R-30.

Background Information

The development of commercial properties on both sides of the existing driveway to the Southwest Wastewater Reclamation Facility (SWWRF) requires the use of a portion of the existing driveway for non-SWWRF commercial customer use. City staff has determined that it would be better to convey this portion of the property back to West Villages Improvement District (WVID) for the following reasons:

> Transfer the risk of the commercial customer use of the driveway from the City of North Port (City) to WVID.

> Provide proper traffic flow.

> Provide better emergency apparatus access throughout both commercial sites.

During the City Commission Special Meeting on March 25, 2020, the Commission approved Resolution No. 2020-R-07, accepting the transfer of ownership of the property related to the Wastewater Treatment Plant from WVID at no cost. Therefore, the return of this portion of the property back to the WVID is recommended at no cost as well. WVID will install a gate at the new property line to prevent non-SWWRF vehicular traffic from entering the City's property.
